三星告蘋果侵權 韓法院判敗訴

（中央社記者姜遠珍首爾12日專電）南韓首爾中央地方法院今天對三星電子告蘋果公司侵犯專利案做出一審判決，裁定被告蘋果並沒有侵犯三星持有的商業專利。

南韓「聯合新聞通訊社」指出，法院裁定認為，三星提出的3項專利中有兩項與蘋果的相關技術相比並沒有技術突破，而其餘一項和蘋果手機的相關功能是完全不同的技術，因此原告所主張的侵權事實不成立。

報導指出，三星電子對判決結果表示遺憾，並表示將繼續上訴。

去年3月，三星電子向首爾中央地方法院提起訴訟，稱蘋果iPhone 4S、iPhone 5、iPad 2等產品侵犯了三星電子的3項商業專利。

報導指出，另一方面，去年8月首爾中央地方法院就三星電子以蘋果公司為對象提起的第一次侵犯專利訴訟，判決三星部分勝訴。

當時法院判決蘋果侵犯三星電子的兩項通訊技術專利，而三星則侵犯了蘋果跳回畫面專利。因此，法院下令禁止銷售蘋果的iPhone 4和三星Galaxy S2等產品。禁售產品中不包括iPhone 4S和iPad 3。之後雙方都提出上訴，但法院至今還未進行審理。1021212
